T-Mobile USA, Inc. and its affiliates (collectively "T-Mobile") has prepared this privacy notice ("Notice") to describe what information about you is collected and how that information may be used, disclosed and protected when you access or use any of our services via the Internet or through any wireless device that allows Internet access. This Notice does not apply to information that may be collected offline. T-Mobile may revise or update this Notice from time to time, so you should refer back to this page often for the latest information.

What is "Personally Identifiable" information and how does it relate to me?

"Personally identifiable" information is information that is directly associated with a specific person such as a subscriber's name, address, or telephone number, e-mail address, location information, or even sometimes information about online or network activities (e.g., log files of Web searching activities).

T-Mobile recognizes that parents may purchase our products and services for family use, including for use by minors. Any information collected from such usage will appear to be that of the subscriber (the parent) and treated as such under this Notice. Further, in accordance with the Children's Online Privacy Protection Act and this Notice, T-Mobile does not design or intend for its products or services to collect personally identifiable information from children under the age of 13. If our policies change in that regard, we will obtain verifiable parental consent before any collection, use or disclosure of such information. Remember that if a child under 13 uses our services with or without your permission to access a site on the Internet, that site's privacy policy (including treatment of information your child provides to that site) will govern. We encourage parents to be involved in the online activities of their children to ensure that no information is collected from a child under 13 without parental permission.

Whenever a business entity subscribes to our services and provides such services to its employees, this Notice generally will govern how we treat the employees' personally identifiable information. However, we view the business entity as the subscriber and our service agreement with the business entity may require that we provide access to or disclose personally identifiable information about an employee's use of the service such as service usage or location information. In that case, the company's own privacy policy will govern how it treats that information.

Our definition of personally identifiable information does not include "aggregate" information. Aggregate information is data we collect about a group or category of services or subscribers from which individual subscriber identities have been removed. In other words, how you use a service may be collected and combined with information about how others use the same service, but no personally identifiable information will be included in the resulting data. Aggregate data helps us understand trends and subscriber needs so that we can better consider new services or tailor existing services to subscriber desires.

When and how is information collected?

We collect "personally identifiable" information in a variety of ways:

Information You Give Us: We collect information you give us when you sign up for, use, or request information about our services or otherwise communicate with us through the Internet or any wireless device which allows Internet access. For example, you provide us with your billing address and credit information when you sign up for service or purchase a product or online content from us. Similarly, you may provide personally identifiable information when you submit a job application online.

Automatically Collected Information: We automatically receive certain types of information whenever you interact with us. For example, we obtain certain types of information when your Web browser accesses a T-Mobile Web site, including your IP address and the type of browser you use. Our wireless system also knows when you are on the network and generally where you are, which is how calls or messages are delivered to you.

Information from Other Sources: We may receive information about you from other sources. For example, we receive credit information from third party sources before initiating service. We may also buy marketing information from others to help us better inform you about new products or services that we think will interest you. This Notice will apply to any such information we add to or combine with personally identifiable information otherwise covered by this Notice.

How do you use "Personally Identifiable" information?

In general, we use "personally identifiable" information for billing purposes, to market and provide services, to anticipate and resolve problems with your service, or to create and inform you of products or services that better meet your needs. For example, by understanding how you use our Web site, we are able to customize and personalize your experience or we may be able to provide information we think will interest you or enable you to conduct transactions more easily. In the case of online job applications, we, or a third party acting on our behalf, collect and use personally identifiable information to communicate with applicants and evaluate their qualifications for employment.

Will "Personally Identifiable" information be disclosed?

T-Mobile is NOT in the business of selling personally identifiable information to others and we disclose "personally identifiable" information only in the following ways:

1. With Your Consent

We may obtain your consent to disclose personally identifiable in a number ways, including in writing; verbally; online by clicking a button; through the use of a dialing string or button on a wireless device or handset; or at the time of initiation or use of any service when your consent is part of the required terms and conditions to use the service. Sometimes your consent is implicit. For example, if you purchase a product through our Web site and request that it be shipped to your home, you implicitly consent to our disclosure of your name and address to a third party shipping company to complete delivery and your charge card number to the bank to collect payment.

2. Transaction Processing

We disclose personally identifiable information to third parties as necessary to complete a transaction or perform a service in our behalf. When the third party acts solely in our behalf, such as a billing service vendor, T-Mobile will restrict their use and disclosure of personally identifiable information. That means that such third party, acting solely on our behalf, will not be permitted to disclose "personally identifiable" information to another third party without your consent.

Our services may let you take advantage of services and products offered by other companies. In those cases, information about you received by those third parties will be governed by their privacy policies. For example, if you are roaming on the network of another carrier, information about your usage and the numbers you dial will be available to the company providing that service. Or, when you purchase a product from a merchant through our wireless Internet service, you may provide "personally identifiable" information to that entity and some information may automatically be passed to the site as well such as your source IP address or other device identifier. Whenever third parties have a role in any such transaction, you should review their privacy policies as well.

3. Certain Business Transfers

T-Mobile has gone through a number of mergers and acquisitions in its history. In such transactions as well as in the event of insolvency, bankruptcy or receivership, "personally identifiable" customer information may be transferred as one of the business assets in the transaction.

4. Protection of T-Mobile and Others

We release personally identifiable and other account information when we believe release is appropriate to comply with the law (e.g., a lawful subpoena, E911 information); to enforce or apply our customer agreements; to initiate, render, bill, and collect for services; or to protect our rights or property, or to protect users of those services and other carriers from fraudulent, abusive, or unlawful use of, or subscription to, such services; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.

5. T-Mobile's Use of "Cookies" in Online or Mobile Advertising

Cookies are small text files placed on your hard drive by a Web site when you visit. These files identify your computer and record your preferences and other data about your visit to that site so that when you return to the site, the site knows who you are and can personalize your visit. For example, cookies are what enable a Web site shopping cart to function so that you only have to check out once.

We may use cookies in general to collect information to determine how to improve our sites by seeing which areas, features and products are most popular; to personalize the site and make recommendations based on products you have liked in the past as well as to improve the site experience; and to complete transactions you have requested. Advertisers that serve ads on our Web sites may also use their own cookies.

T-Mobile may use third-party advertising companies to provide our ads on the Internet. These companies may use cookie technology to measure the effectiveness of our ads. The cookies used by such vendor are associated with a specific computer and a specific Internet browser program through an anonymous number and do NOT use your name, address, phone number, email address, or anything that personally identifies you. The use of such cookies is subject to the vendor's privacy policy, not the policy of T-Mobile. T-Mobile may ask these companies to report back information to us and in such a case, that information, if linked to personally identifiable information, will be treated as such and governed by this Notice. This Notice will be updated to provide you with more information should these practices be modified or changed in any material way.

With Internet access through the use of wireless devices, cookies are used by third party vendors to facilitate the service. The vendors keep a cookie-like functionality for users on their own servers. This functionality will not be physically installed on the users' devices, but will be installed in the vendor's server. This functionality will recognize authorized users when they begin to browse the Internet. This cookie-like functionality is in place for the same reasons and designed for the same purposes as cookies installed on your computer, but the information is in the hands of a third party and subject to their privacy practices rather than exclusively those of T-Mobile.

As technology advances and cookies provide more functionality, we expect to utilize them in different offerings in different ways. As we do so, this Notice will be updated to provide you with more information.

You also may have heard about Web bugs, a small, graphic image on a Web page or in an Email message that is designed to monitor who is reading the Web page or Email message. Web bugs are often invisible to the user because they are typically very small (only 1-by-1 pixel) and the same color as the background of the Web page or Email message. Web bugs are represented as HTML IMG tags in the Web page; users should click on "view profiles" of the Web page to see whether the page is using a Web bug. T-Mobile does not permit third parties to use Web bugs on its sites.

You may choose not to receive unsolicited online offers or advertisements unrelated to your service directly from us via wireless Web services such as, for example, SMS Text Messaging, Voice/Recorded Messages to your wireless device, or email, by modifying your online profile at www.t-mobile.com/mytmobile. For T-Mobile HotSpot users, you may choose to receive e-mail or other communications from some of our marketing and site partners. You may modify your selection at any time by contacting HotSpot Customer Service by telephone (877.822.SPOT (7768)) or e-mail (HotSpotcustomerservice@t-mobile.com). There may be a period of time after you modify your profile before such changes take effect.

Not all advertisements appearing on your mobile phone or device are authorized by T-Mobile. We take steps to reduce unsolicited bulk messages, but we cannot at this time block all unsolicited wireless advertising. We continue to look for other options to continue to reduce these unsolicited bulk messages.

What about location-based services and information?

Whenever your mobile device is on, the network generally knows its "location." This location capability is what makes wireless communications possible and is how we properly bill for services. This location technology also is the basis for providing enhanced emergency 9-1-1 services.

Currently, we disclose location information to third parties when required to do so such as in emergency situations to a public safety answering point, emergency medical service provider or emergency dispatch provider, public safety, fire service, or law enforcement official, or hospital emergency or trauma care facility, or to respond to a user's call for emergency services. The law also permits us to disclose location information without consent to inform a user's legal guardian or members of a user's immediate family of the user's location in an emergency situation that involves the risk of death or serious physical harm, or to providers or managers of information in order to assist in the delivery of emergency services, or to government agencies if we reasonably believe that an emergency involving immediate danger of death or serious physical injury justifies disclosure without delay.

While the T-Mobile HotSpot service may be capable of providing certain location-based information, there is no process currently in place for making such information available in emergency situations to providers of emergency services.

T-Mobile may develop commercial location-based technologies that would bring exciting new services to our subscribers. This Notice generally will govern how location information will be collected, used and disclosed. You should also review the terms and conditions of service for any special rules governing location services.

Is information secure?

T-Mobile maintains physical, electronic, and procedural safeguards for information collected through the use of its Web site that meet with industry standards and any applicable federal regulations. For example, we use Secure Socket Layer (SSL) software, which encrypts information you input, to enable you to securely view your account information on our Web site. You should be aware that we have no control over the security of other sites on the Internet you visit, interact with, or from which you buy products or services. For information on T-Mobile HotSpot Security, please refer to the relevant links on the T-Mobile HotSpot sites.

We limit access to personal information about you to those employees who need to know that information to provide products or services to you. An important part of protecting the security of personal information is your efforts to protect against unauthorized access to your wireless device, user name and password and to your computer. Also, be sure to sign off when finished using a shared computer and always log out of any site when viewing personal account information.

T-Mobile makes no representations or warranties about the security of its wireless Web access services or that your use will be error-free, uninterrupted, or free of infection by viruses or other malicious codes or acts of third parties beyond our control.

How do you check account information?

You may change your username, password, and certain other information at any time by selecting "Update My Profile" at www.t-mobile.com/mytmobile. You may also view your monthly bill by selecting "View My Account Info" at www.t-mobile.com/mytmobile. You may also call an account representative for assistance.

For T-Mobile HotSpot users, you may access your HotSpot account information at http://hotspot.t-mobile.com. You may change your account profile and view your current balance by selecting "View Account Information."

Will this notice be changed in the future?

T-Mobile may update this Notice in the future for a variety of reasons including, but not limited to, changes in technology or the introduction of new services. You should refer back to this page often for the latest information.
